Property division between cohabitants
The decision to go separate ways is rarely easy. This not only means a lot of emotional difficulties, but also practical and legal issues that need to be resolved.
If you are cohabiting and are going to separate, a property division can be done if one of you requests it. Then the value of the home and household goods that you bought for joint use is shared, after settlement for debts. Housing means tenancy, condominium or real estate, and household goods are what is in the housing, such as furniture, fridge and freezer. Debts are normally only counted if they are directly connected to something in the home that you bought for joint use.
A property division between cohabitants does not include holiday homes and other such property that each of you bought and that is not your home or part of your joint household.
You can request property division no later than one year after a cohabitation relationship ends due to separation. In the event of death, a request for estate division must be made at the time of the probate procedure at the latest.
