It is rarely an easy decision to divorce or separate. Often it is emotionally difficult, but also involves many practical and legal issues that need to be resolved when you have been married.

When dividing property, your assets are divided equally after deducting debts. Everything is included and valued – home, household goods, shares, car, holiday home, money in accounts and pension savings. You each get half of the total value of everything after debts are deducted. How you then divide the assets practically is up to you.

What is individual property according to a prenuptial agreement, testament or deed of gift is not included in the division of property.

A property division between spouses can be made during an ongoing marriage or when the marriage ends due to divorce or death. Since the assets are valued according to the value at the time of filing for divorce, it is wise to do the property division in connection with it. This is to facilitate the legal process.

There is no need to make a division of property in the event of death if you only have joint children and there is no testament. Then the survivor inherits the deceased's share of the estate.
